Credit Cards

We accept the following credit cards: Visa, Mastercard, and American Express. There is no surcharge for using your credit card to make purchases. Please be sure to provide your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order.

Age Verification

All products sold on smoktek.com contain or are intended for use with nicotine, which is an addictive chemical. By placing an order on this site, you confirm that you are 21 years of age or older. SmokTek reserves the right to cancel any order where age verification cannot be confirmed. Orders cancelled for this reason will be fully refunded. It is a violation of federal law to purchase or attempt to purchase nicotine or tobacco products if you are under the age of 21.

PACT Act Compliance

SmokTek, LLC complies with all applicable provisions of the Prevent All Cigarette Trafficking (PACT) Act, including age verification requirements for all online purchases of nicotine and vapor products. We verify customer age at checkout and report applicable transactions to state tax authorities as required by law. By placing an order, you consent to the age verification process and confirm that all information provided is accurate.

Returns, Refunds, Cancellations and Warranty

SmokTek does not accept returns or issue refunds on orders that were shipped without shipping insurance. Shipping insurance is offered to all customers at checkout and is strongly recommended.

If you added shipping insurance at checkout and your order arrives damaged, please contact us and we will offer you the choice of a full store credit or a replacement shipment sent at no additional cost. This applies only to orders where insurance was selected at checkout. No exceptions will be made for orders shipped without insurance.

Orders may be cancelled at any time prior to shipment. Once an order has shipped, it cannot be cancelled.

Out-of-Stock Products

We will ship your product as it becomes available. Usually, products ship the same day if ordered by 1:00 PM EST Monday through Friday, or by the next business day if your order is received after this time or on weekends and major holidays. There may be times when a product you have ordered is out of stock, which will delay fulfillment. We will keep you informed of any out-of-stock items in your order. You may cancel your order at any time prior to shipping.

Multiple Product Orders

For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. SmokTek reserves the right at any time after receipt of your order to accept or decline your order for any reason, or to supply less than the quantity you ordered of any item.

Typographical Errors

In the event a product is listed at an incorrect price due to a typographical error or error in pricing information received from our suppliers, SmokTek shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price. SmokTek shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, SmokTek will issue a credit to your credit card account in the amount of the incorrect price.

Taxes

SmokTek, LLC automatically charges and withholds applicable sales tax for orders delivered to addresses within the state of Florida. For orders shipped to other states, applicable sales tax will be collected where SmokTek is required to do so under applicable state law, including states where SmokTek has established economic nexus. Customers are responsible for any additional state or local taxes that may apply and are not collected by SmokTek at checkout.

We keep your personal information private and secure. When you make a purchase from our site, you provide your name, email address, credit card information, address, phone number, and a password. Money Orders, Cashier's Checks, Company Checks & Personal Checks

We do not accept money orders, cashier's checks, company checks, or personal checks. Only major credit and debit cards are accepted.

Limitation of Liability

To the fullest extent permitted by applicable law, SmokTek, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of this site or any products purchased through it. SmokTek's total liability to you for any claim arising from or related to these terms or your purchase shall not exceed the total amount paid by you for the order giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.

Governing Law

These terms and conditions and any dispute arising out of or related to your use of this site or any purchase made through it shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the state or federal courts located in Pinellas County, Florida.

Other Conditions

These conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether SmokTek, LLC signs them or not. We reserve the right to make changes to this site and these conditions at any time. Continued use of this site following any changes constitutes your acceptance of the revised terms.
